The defendant being an American Citizen, it is usual, as a matter of courtesy, to offer the Consul a seat on the Bench. Mr. Mitchell then addressed Mr. Munson in most contemptuous manner, saying the following words:
That such was the custom, but that on former occasions Mr. Munson had grossly insulted the Court in a most disgraceful way, and that no courtesy should be extended to him, and that he would not offer him a seat on the Bench.
